케냐 법원 "동성애자 차별은 위헌" 판결 내리다

아프리카에서 동성애 인권의 역사적 판결이 내려졌다.

케냐 고등법원은 지난 4월 27일 성소수자 차별은 위헌이라는 판결을 내렸다.

연합뉴스는 4월 28일 케냐 현지 일간 데일리 네이션 인터넷판을 인용해 "케냐 고등법원은 판결문에서 '케냐 헌법은 성적 지향이 다른 사람 등 소수자의 권리를 인정하고 보호한다'며 관련 기관에 한 동성애 단체 대표가 접수한 NGO 등록 신청을 인가하라고 명령했다"고 보도했다.

케냐 NGO 협회는 지난 2013년 성소수자 인권 단체의 대표가 요청한 NGO 등록 신청을 거절했고, 케냐 검찰과 종교계도 성소수자 단체의 NGO 등록을 지속적으로 반대했다.

그러나 4월 27일 케냐 고등법원 재판관들은 "케냐 헌법이 도덕과 종교의 기준에 따라 국민의 권리를 제한하지 않는다"며 동성애 단체의 NGO 등록을 인가해 준 것이다.

아프리카는 지구에서 가장 성소수자들에게 가혹한 대륙이다. 특히 우간다는 동성 성인간 합의에 의해 이루어지는 성관계로도 무기징역을 선고할 수 있고 동성애 인권운동 자체를 불법으로 간주하는 반 동성애 법안으로 악명이 높다.

그러나 아프리카도 점점 변화의 조짐이 보이고 있다. 지난 2014년 11월 5일 보츠와나 법원은 성소수자 단체를 처음으로 법적으로 인정하는 판결을 내렸다. 케냐의 이번 판결도 아프리카 대륙의 성소수자 인권에 하나의 전환점이 될 가능성이 크다.
