2016년 개봉한 영화 〈미 비포 유(Me before you)〉에서 촉망받던 젊은 사업가였던 윌은 불의의 사고로 모든 것을 잃는다. 사지마비 환자가 된 윌은 6개월 뒤 스위스로 가서 안락사를 하기로 결심한다. 연인인 루이자는 그가 마음을 바꿀 수 있도록 애쓰지만 사랑도 그의 결심을 바꾸진 못한다. 반송장인 현재의 모습으로 살아가는 건 죽음보다 더한 고통이었기 때문이다.

그렇다면 실제로 영화 〈미 비포 유〉처럼 해외에서 죽음을 선택하는 것이 가능한 일일까. 비온뒤는 스위스 '디그니타스(Dignitas)'를 이메일 인터뷰를 통해 만났다. 디그니타스는 안락사를 주선하는 스위스 비영리기관으로 전세계적으로 유일하게 자국인이 아닌 외국인에게도 안락사를 허용한다.

디그니타스는 엄밀한 의미에서 안락사가 아닌 조력자살 방식으로 말기암 등 고통에 시달리는 환자들을 돕는다. 즉 의사 등 타인이 독극물을 주입하는 방식이 아니라 환자가 자발적 의지를 갖고 자신의 손으로 강력한 수면제 등을 복용하거나 주사한다.

스위스에선 이러한 디그니타스의 활동이 합법적이며 죽음의 자기결정권을 돕기 위한 인도적 차원의 봉사로 이해하므로 외국인에게도 허용된다. 그러나 어떠한 의학적 방법으로도 도움을 받을 수 없는 말기 환자라야 하며 환자의 자발적 동의가 필요하다.

자살유도 약물은 스위스 의사의 처방을 거쳐야 하며 시술은 병원이 아닌 민간 자택이나 아파트에서 이뤄진다. 의사나 간호사도 없고 수술대나 기구 등 의료 장비도 없다. 비용은 장례 포함 1,000~1,400만원 정도 소요되는 것으로 알려져 있다. 그러나 비용이 획일적인 것은 아니며 신청자의 경제적 환경이 어려운 경우 이를 감안해 낮춰주기도 한다고 밝혔다.

디그니타스는 한국인 신청자가 2012년 이래 지금까지 모두 18명이 있었다고 공개했다.

아시아에서 가장 높은 수치다. 이들중 실제 몇 명이 안락사를 했는지는 공개하지 않았다.

전세계적으론 96개국에서 7,764명이 신청했다. 독일이 3,223명으로 가장 많았고 영국인 1,139명, 프랑스인 730명, 스위스 684명, 이탈리아 392명의 순서를 보였다. 캘리포니아 등 일부 주에서 안락사가 합법화된 미국도 453명이 신청했으며 아시아에선 우리나라의 뒤를 이어 일본인 17명, 태국인 10명, 중국 7명 순이다.

- 적극적 안락사 : 병자의 생명을 '타인이' 적극적으로 끊음으로써 그를 죽음의 고통에서 해방시키는 경우

- 조력자살 : 의료진으로부터 약물을 처방받아 '스스로' 목숨을 끊는 경우

- 소극적 안락사 : 생명을 연장하는 치료가 의미가 없기 때문에 생명 유지에 필수적인 영양공급, 약물 투여 등을 중단함으로써 결국 죽음에 이르게 하는 경우

세계 최초로 안락사를 합법화한 나라는 2002년 네덜란드다. 조력자살 방식이 아니라 독극물을 의사가 직접 주입해 신청자의 사망을 유도하는 적극적 안락사다. 네덜란드에서 전 국민의 4%가 안락사로 생명을 마감한다. 올해는 말기암 등 질환이 아닌 단순히 나이가 많이 들어 의식과 활동이 쇠약해지고 고독 등 고통에 시달릴 경우에도 안락사를 허용하는 내용의 법안마저 통과될 전망이다.

현재 네덜란드를 비롯해 벨기에, 룩셈부르크, 스위스, 콜롬비아, 캐나다까지 6개 국가에서 안락사를 허용하고 있다. 미국은 주마다 다르다. 현재까지 오레곤과 워싱턴, 몬태나, 버몬트, 캘리포니아의 5개 주에서 합법화되었다.

그러나 뉴욕주가 올해 안락사를 합법화하고 2015년 안락사 법을 부결시킨 영국도 재추진한다는 보도가 잇따르는 등 안락사로 상징되는 죽을 권리를 향한 움직임은 전세계적으로 확산되는 양상이다.

우리나라는 연명치료의 중단이라는 소극적 의미의 안락사 법안이 국회를 통과해 2018년부터 시행될 예정이다.

우리나라 실정법에 따르면 안락사는 조력자살이라도 불법이다. 따라서 스위스 디그니타스를 통한 안락사 신청자는 처벌될 수 있다.

안락사는 찬반 양론이 첨예하게 맞서 있어 법적, 윤리적으로 매우 민감한 사안이다. 그러나 죽음의 자기결정권을 주장하는 목소리가 국내에서도 갈수록 높아져 가고 있으므로 어떤 형태든 사회적 합의를 위한 노력이 시급해 보인다.

아래는 독자 여러분의 이해를 돕기 위해 디그니타스의 답변 내용을 원문 그대로 소개한다.

Q1. 외국인에게도 조력자살을 허용하는데, 이유는 무엇인가.

A1. 일단 몇 가지 오해가 있다. 우선 디그니타스는 클리닉이나 병원이 아닌 '자기 결정과 존엄성을 옹호하는 비영리 단체'다. 그렇게 때문에 우리는 의사와 간호사가 없으며, 치료나 수술을 받을 수 있는 시설이 없다. 대부분의 과정은 개인 주택 및 아파트에서 이루어진다.

또한 두 번째로 가장 많은 오해가 디그니타스에서 안락사를 할 수 있다는 것이다. 스위스에서는 적극적 안락사를 법적으로 금지하고 있기 때문에, 우리는 안락사를 제공하지 않는다. 정확한 용어로 말하자면, 저희가 제공하는 것은 조력자살이다. 조력자살은 완전한 판단력을 가지고 자신의 인생을 끝내기를 원하는 개인이 치명적인 약(또는 다른 방법)을 스스로 투여 하는 것이다.

There two common misunderstandings regarding Dignitas' work which can arise when consulting unreliable sources of information and which need clarification.

1) The first one is about the idea that Dignitas would be a 'clinic' or a 'hospital'. However, the 'Dignitas-clinic' is an invention by incompetent journalists and the tabloids. Dignitas is a help-to-life and right-to-die nonprofit members' society, a self-determination and dignity advocacy group, but definitely not a clinic. There are no doctors and no nurses hastening around in wards here, no emergency-room, no facility for patients to stay for days and weeks and be treated / looked after, etc. Besides, in Switzerland, assistance in self-determinedly ending one's suffering and life generally takes places at the private house/flat of the individual. Not in clinics and not in hospitals!

2) A second misunderstanding which comes up again and again is that Dignitas would offer 'euthanasia'. However, Dignitas does not offer voluntary or involuntary active euthanasia, because this is prohibited in Switzerland. Besides, 'euthanasia' is an ambiguous term. Actually, it roots in the Greek language, simply meaning 'good, mild, gentle death'. But the word's use ranges from all sorts of help at the end of life, to putting down animals, and to certain practices of the holocaust during WWII.

What is possible in Switzerland as an option to self-determinedly ending one's suffering is 'assisted suicide' - or as we call it more precisely: 'accompanied suicide'. This expression makes clear what it is: a conscious, well-considered and prepared ending of one's suffering and life by own action. An accompanied suicide means that the individual wishing to end his or her life must be able to administer the lethal drug (or any other method) by himself or herself. And he or she must have full capacity of judgment. Most important, the person is not left alone, but may end his/her life in presence of next-of-kin and friends. All this after a careful preparation process. This in contrast to all the lonely "clandestine" suicides, of which the majority fails (some literature speaks of a failure rate of up to 49 : 1 !).

especially the graph/chart. Every day, people contact us to ask for advice. Some just need someone to talk to, others need advice in patient's rights issues, some are stricken by a terminal illness at a very advanced stage and need to be directed towards a clinic with a palliative ward, and some are even medical doctors who inquire how they may help their patients. A lot of these people are not even members - yet receive advice from us as far as possible.

Dignitas' aim is not that people from all over the world travel to Switzerland, but rather that other countries adapt their legal system to implement end-of-life-issues so that citizens have a real choice and do not need to become a "suicide tourist" (which is a horrible word anyway: in fact these people are "freedom tourists" or "self-determination tourists"!). The core goal of Dignitas is, that Dignitas one day does not exist anymore - because people can have their will at home and don't need an association like Dignitas.

Our work is not just about "how to end your life self-determinedly". As already indicated, many other topics in our society are connected to it, such as:

∙ The massive problem of the high number of "clandestine" suicides and the much higher number of attempted yet failed suicide attempts (see the chart/graph at the link mentioned above). Many questions arise from this such as: what is wrong with our society that so many people want to "opt out"? What about the costs connected to this for the public, due to emergency services, police, coroners, etc having to deal with these "cases" - not to forget their emotional distress and the emotional distress of those who are "left behind" with many more questions than answers?

∙ The problems with the public health system which (very much so here in Switzerland) gets more and more expensive, to the point that some families have to trouble making ends meet

∙ The fact that our "western" society gets older and older: who will care for the elderly? And who will pay for their care?

∙ The "power-question": who decides on whom? The politicians or the church over the citizens or the citizens for themselves? Whose life is it anyway?

If necessary, and on reasoned request, Dignitas works totally for free for its members, because Dignitas is not a hospital, but a non-profit organisation. We work on a "all for one - one for all" basis, which means, that the people who have (a lot) of money, pay a lot so that those people who only have little or no money can have access to our services as well. Of course, there are certain "prices" in our information-brochure, but this does not change our non-profit approach because some pay this, some pay more and some pay nothing at all. Sometimes, this is a big problem for us financially, but so far we managed to survive....
